Bringabottle.Party provides this Website subject to your compliance with the terms and conditions set forth in this agreement (the "Agreement").
The Terms and Conditions are subject to change by Bringabottle.Party at any time, effective upon posting on the Bringabottle.Party website, and your use of the service after such posting will constitute acceptance by you of such changes.
This site is owned and made available by Bringabottle.Party referred to in these Terms and Conditions as "we" and "us". The Terms and Conditions form part of an agreement between you, and ourselves and sets out the conditions under which you may access the Bringabottle.Party Site to use our services and advertisements (the "Material") available through the Bringabottle.Party.

Please do not take any Member Content and information as wholly accurate, we will not be responsible for false and misleading statements given by other Members. 2. No warranty
2.1 The Bringabottle Party Site is provided on an "as is" and "as available" basis and in particular we do not warrant that:
a) The Bringabottle Party Site will continue to be available to you in either its current format;
b) the Material contained on the Bringabottle Party Site will be true, accurate or complete in all respects, except always to the extent otherwise set out in the Terms and Conditions and to any warranties which would be implied by law (including without limitation, warranties as to satisfactory quality and fitness for a particular purpose).
2.2 We make no representations and give no warranties with regard to the quality, suitability, reliability, compatibility, accuracy, non-infringement or completeness of the contents or Members of the Bringabottle Party Site, and any implied warranties are excluded to the extent permitted by law.
2.3 We do not warrant that this Bringabottle Party Site, the server that supplies it, or any other of our systems will be uninterrupted or free of errors, viruses or bugs and we shall not be liable if this site is inaccessible at any time. 4.3 To the extent that our website and the information and services on our website are provided for a membership fee, we will not be liable for any loss or damage of any nature.
4.4 We will not be liable to you in respect of any losses arising out of any event or events beyond our reasonable control.
4.5 We will not be liable to you in respect of any business losses, including (without limitation) loss of or damage to profits, income, revenue, use, production, anticipated savings, business, contracts, commercial opportunities or goodwill.
4.6 We will not be liable to you in respect of any loss or corruption of any data, database or software.
4.7 We will not be liable to you in respect of any special, indirect or consequential loss or damage.
4.8 You accept that we have an interest in limiting the personal liability of our officers and employees and, having regard to that interest, you acknowledge that we are a limited liability entity; you agree that you will not bring any claim personally against our officers or employees in respect of any losses you suffer in connection with the website or these terms and conditions (this will not, of course, limit or exclude the liability of the limited liability entity itself for the acts and omissions of our officers and employees).
5. Breaches of these terms and conditions
5.1 Without prejudice to our other rights under these terms and conditions, if you breach these terms and conditions in any way, or if we reasonably suspect that you have breached these terms and conditions in any way, we may:
(a) send you one or more formal warnings;
(b) temporarily suspend your access to our website;
(c) permanently prohibit you from accessing our website;
(d) commence legal action against you, whether for breach of contract or otherwise; and/or
(e) suspend or delete your account on our website.
5.2 Where we suspend or prohibit or block your access to our website or a part of our website, you must not take any action to circumvent such suspension or prohibition or blocking (including without limitation [creating and/or using a different account).
6. Downloadable Material
6.1 All our downloadable material is carefully checked for viruses before being uploaded onto the site, however we recommend that, as an extra precaution you run your own virus check on each document you download before saving it to your disk or hard drive.

7.1 You undertake:

7.2 That you will indemnify and defend us against all claims, liability, damages, costs and expenses, including legal fees, arising out of a breach of these Terms and Conditions or any use of the Material or the Site.
7.3 We shall have the right to immediately suspend your access to the Bringabottle Party Site if you commit a breach of these Terms and Conditions.
7.4 Your right to use the Service is subject to any limitations, conditions and restrictions established by us from time to time, in our sole discretion.
8. Intellectual Property Rights

Should you decide to contract with any of these organisations, the contract will be directly between you and the relevant organisation. We will have no contractual involvement, and will not be liable in contract or otherwise for any products, information, materials or services provided to you by any of these organisations.
10.2 We DO NOT allow: pedophilia, incest, zoophilia, graphic violence and any other type of abusive, obscene or illegal materials. Website administration abides by a zero-tolerance policy towards any inappropriate content.
11. Registration and accounts
11.1 When seeking access to parts of the Bringabottle.Party Site, such access to interact with other Members you will be asked to register and/or subscribe (for a fee). You must then supply certain details if requested, such as your email address and a password. To become a Member and you can only access the registration areas of the site if:
a) To be eligible for an account on our website you must be resident or situated in the United Kingdom;
b) You must be aged 18 or older;
c) You may register for an account with our website by completing and submitting the account registration form on our website and clicking on the verification link in the email that the website will send to you;
d) You must not allow any other person to use your account to access the website;
e) You must notify us in writing immediately if you become aware of any unauthorised use of your account;
f) You must not use any other person's account to access the website, unless you have that person's express permission to do so.
12. User login details
12.1 If you register for an account with our website, you will be asked to choose a user ID and password.
12.2 Your user ID must not be liable to mislead and must comply with the content rules set out in Section 10 and 16; you must not use your account or user ID for or in connection with the impersonation of any person.
12.3 You must keep your password confidential.
12.4 You must notify us in writing immediately if you become aware of any disclosure of your password.
12.5 You are responsible for any activity on our website arising out of any failure to keep your password confidential and may be held liable for any losses arising out of such a failure.
12.6 If we believe that you have not complied with these requirements, we may cancel your access to the site immediately and without notice.
13. Membership
13.1 You profile will be posted for after getting through the registration procedure and paying the relevant membership fee that clearly specified in Section 14 of this Terms and Conditions.
14. Fees
14.1 Since some of our services are non-free, we take fees for:
a) Normal membership £99.00 per year or;
b) Twelve-month membership for £49.00 (available only until 30 June 2020)
c) Six-month membership for £30.00 or;
d) Launch offer worth £10 per month for a six-month period;
e) Party Season Specials worth £20 for three-month (available July 2020 to January 2021 only);
14.2 We may change our fee schedule at any time and the new fee schedule shall be enforce immediately upon publication of the same on our Website or upon notice to you via email. All currency references are in the GBP currency.
15. Rejection, cancellation or suspension
15.1 We can at our discretion, refuse any application to become a Member.
15.2 We may also suspend or cancel this agreement and your ability to use the Bringabottle Party Site with immediate effect, at any time for any reason, including but not restricted to your serious or repeated breach of these Terms and Conditions or any conduct in connection with your use of the Bringabottle Party Site that we consider inappropriate or disruptive and which is serious or persistent.
15.3 We will notify you of such termination at your registered email address and invalidate your access to the Bringabottle Party Site.
16. Your content: rules
16.1 You warrant and represent that your content will comply with these terms and conditions.
16.2 Your content must not be illegal or unlawful, must not infringe any person's legal rights, and must not be capable of giving rise to legal action against any person (in each case in any jurisdiction and under any applicable law).
16.3 Your content, and the use of your content by us in accordance with these terms and conditions, must not:

(h) be in breach of racial or religious hatred or discrimination legislation;
(i) be blasphemous;

(k) be in breach of any contractual obligation owed to any person;
(l) depict violence in an explicit, graphic or gratuitous manner;
(m) be pornographic, lewd, suggestive or sexually explicit;
(n) be untrue, false, inaccurate or misleading;
(o) consist of or contain any instructions, advice or other information which may be acted upon and could, if acted upon, cause illness, injury or death, or any other loss or damage;
(p) constitute spam;

c) we do not, as a matter of course, actively moderate, monitor or edit the Member contributions to the Bringabottle Party Site and its community;
d) any third parties advertising on our Bringabottle Party Site, or external (or link) sites accessible via our websites, are not under our control and we are not responsible in any way for any of their contents or for any agreement you may enter into with a third party arising from your visit to our websites.

22.1 We reserve the right to monitor all public postings, messages, video and audio recordings to ensure that they conform to the content guidelines which may be applicable from time to time.
23. Assignment
23.1 You hereby agree that we may assign, transfer, sub-contract or otherwise deal with our rights and/or obligations under these terms and conditions.
23.2 You may not without our prior written consent assign, transfer, sub-contract or otherwise deal with any of your rights and/or obligations under these terms and conditions.
24. Severability
24.1 If a provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect.
24.2 If any unlawful and/or unenforceable provision of these terms and conditions would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.
25. Law and jurisdiction
25.1 These terms and conditions shall be governed by and construed in accordance with English & Wales law.
25.2 Any disputes relating to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of England & Wales.
